In the event Guardian Solutions fails to develop a commercial loan modification solution to help commercial property owners with their current property liability and save their property, Guardian Solutions shall pay a refund to the eligible business owner for the retainer paid by business owner. The business owner must provide accurate and truthful information and must be motivated to save their property and be willing to take the steps required by Guardian Solutions in order to help the company save their property.
If the business owner changes their mind and decides not to save their property or seeks other alternatives, or is non-responsive (e.g., not returning phone calls, not providing documentation required by lender, etc.), the business owner is not eligible for a refund.
Any refund claim must be submitted together with all supporting documentation within 21 days of the closing of the business owner ’s file by Guardian Solutions or termination of this contract by business owners.
Eligibility:
Even though Guardian Solutions always applies its maximum expertise and best professional effort to each of its customers, the guarantee stated above does not apply in the following situations:
If business owners have sought a voluntary dismissal of a bankruptcy case in response to the mortgage lender’s motion to lift the automatic stay.
If business owner ’s mortgage lender has been named in two or more bankruptcy cases in the past 18 months where business owner and/or any co-owners have been a petitioner.
If business owners have filed a Chapter 13 which was converted to a Chapter 7 during the last six months. [Even if business owner ’s situation creates one of the above exceptions, we are very often successful at working out a viable plan regardless of whether or not an exception to the guarantee exists.
If business owners have violated this agreement in any way. In the event business owners cancel this agreement prior to complete performance by Guardian Solutions hereunder, the maximum refund, if any, available to business owners shall be determined solely by Guardian Solutions and shall not exceed the fee paid, in any event.
If any processing fee paid to or work performed by an outside contractor that may be employed to process such information.
